When will recreational marijuana sales begin?

Consumers have been able to possess up to 3 ounces of cannabis since December 8, 2022. However, cannabis is still not available for purchase in Missouri-licensed dispensaries. Medical facilities must convert to comprehensive facility licenses. The state of Missouri began accepting applications for these conversions on December 8th, 2022, and has 60 days from receipt to approve requests. This means that recreational marijuana could be available for purchase as soon as February 6th, 2023.   Once the comprehensive dispensary has been approved, it is left up to their discretion as to when they will begin selling cannabis for adult use.

Are possession limits different for medical and adult-use marijuana?

Patient/Caregiver Limits: An approved Caregiver ID card holder representing a licensed medical patient, or an approved Patient ID card holder, may purchase no more than 6 ounces of dried, processed cannabis or the equivalent within a period of 30 days. Physicians and nurse practitioners may certify patients for greater amounts. Those with patient ID cards, or caregiver ID card holders representing a licensed patient, can possess up to a 60-day supply (12 ounces). Physicians and nurse practitioners may authorize more than 6 ounces in a 30-day window. Adult-Use Limits: Recreational consumers may possess up to 3 ounces of dried, processed marijuana or its equivalent.

Can qualifying patient ID card holders be authorized to purchase or possess more than 6 ounces?

Yes. Certifying physicians and nurse practitioners can determine whether there is a compelling reason to authorize the purchase and possession of more than 6 ounces of medical marijuana. This higher amount must be certified on the appropriate certification form.

Is there a patient cultivation limit?

If the cultivation is for medical use, approved patient and caregiver ID card holders may be in possession of up to a 90-day supply of unprocessed, dried cannabis (or its equivalent). Any amount that surpasses the patient’s 60-day allotment must remain in an approved enclosed and locked facility.

Are there possession limits for approved caregiver ID card holders?

Yes. Caregiver ID holders can possess a separate legal limit for each qualifying patient in their care. This is limited to up to 6 patients. A separate legal limit exists for approved caregivers if they’re also a qualifying patient. All medical cannabis in the possession of the caregiver must be stored separately and labeled for each patient. Unless the person in question is also an approved cultivator, they must adhere to the legal possession limit of a 60-day supply (12 ounces). In the case of approved cultivators, they can possess up to a 90-day supply of dry, unprocessed cannabis or its equivalent. However, the amount in excess of the patient’s legal 60-day supply must remain in an approved, enclosed facility that can be locked.

What are the adult-use purchase and possession limits?

Consumers can legally purchase up to 3 ounces of recreational marijuana in a single transaction. They can legally possess up to 3 ounces of dried, processed cannabis or its equivalent.

What are the possession limits for personal, adult-use (consumer) cultivation?

Accepted Answer

Those with consumer personal cultivation ID cards are limited to their 3-ounce possession limit of cultivated cannabis, and it must be kept at their residence within an approved locking enclosure.

Do I need a medical card to enter a dispensary in Missouri now?

Accepted Answer

The official date hasn’t been announced by the state yet, but we expect recreational sales to start by the end of February. At that time, you won’t be required to have a medical card. However, you will still need to show a valid state or government-issued ID. Until recreational sales begin, you must be at least 18 years of age and have a state-issued medical card to enter or purchase from a dispensary.

Are there different tax rates for medical patients versus recreational users?

Accepted Answer

Yes. Medical marijuana patients will continue to pay a 4% tax on their medical cannabis purchases. Recreational users will be taxed at 6% while local municipalities are allowed to increase that percentage.

Can non-residents purchase recreational marijuana in Missouri?

Accepted Answer

When recreational sales begin, anyone over the age of 21 will be legally allowed to purchase adult-use marijuana no matter their state of residency. However, these cannabis products must be consumed here in Missouri as it is still federally illegal to transport marijuana across state lines.
